1. Uncontested Divorce & Separation Agreement in BC
As an uncontested divorce lawyer serving Vancouver and all of BC, we know the Divorce Act’s actual requirements — grounds, typically a year of separation, residency, and a paperwork process where a single unclear date or missing clause is enough to send an application back to the start. We begin by drafting a solid separation agreement, settling guardianship, support, and property before anything is filed, so the terms carry through cleanly rather than being reopened later once the divorce itself is already underway. From there, we prepare and file your (Joint) Family Claim with accuracy and full transparency, manage the waiting period, and carry those already-settled terms through to your final divorce order — filed correctly the first time around.
2. Custody & Parenting Arrangement in BC
As a custody lawyer serving families across BC, we know a child’s arrangement isn’t decided by which parent asks loudest — it turns on the best interests of the child, weighed against factors like stability, each parent’s capacity to meet the child’s needs, and the strength of each relationship. Married parents going through divorce fall under the federal Divorce Act; BC’s Family Law Act governs guardianship for every parent in the province, regardless of marital status. Rather than reaching for a standard schedule, we start slower: real conversation between both parents, before a single term is drafted. We put parenting time and decision-making responsibility into terms fully compliant with BC and federal law — a plan built to be lived, not merely signed.
3. Support & Property Division
As a child support and spousal support lawyer in BC, we work with two different formulas, and neither is simple in practice: child support tracks the Federal Child Support Guidelines by income and number of children, while spousal support has no formula at all — only a range under the Spousal Support Advisory Guidelines, shaped by relationship length and each spouse’s circumstances. Property division adds its own layer, since what counts as family property under BC’s Family Law Act, and how pensions or a business is valued, is rarely straightforward. None of this works without complete financial disclosure, which we treat as a non-negotiable first step. We calculate and negotiate support accurately, and value and divide family property fairly and equitably.
4. Prenuptial Agreement & Marriage Contract in BC
As a prenuptial agreement and marriage contract lawyer in Vancouver, we know an agreement is only as strong as what stands behind it — full financial disclosure from both sides and independent legal advice for each spouse, built in from the start rather than added later once a dispute has already arisen. We draft prenuptial agreements and marriage contracts engineered to actually hold up under review, not just to be signed and quietly set aside. The goal is a clear, airtight structure that protects what each of you brought into the relationship, while fully respecting your partner’s entitlements under BC family law — so the agreement still works exactly as intended, whenever it’s actually needed most.
5. Immigration Applications: Visa, PR & Citizenship
As an immigration lawyer serving Vancouver and BC, we know every visa, permanent residence, or citizenship application turns on documentation IRCC will actually accept, not just paperwork that merely looks complete at first glance. We prepare and submit your immigration application with full, accurate supporting evidence: identity documents, education and employment records, language test results, and everything else your specific pathway requires, gathered and organized to hold up under scrutiny. We tell you plainly what’s needed and what isn’t, so nothing essential gets missed and nothing unnecessary slows the process down. The result is an application built to succeed the first time it’s reviewed, not one that comes back with further requests for evidence.
6. Judicial Review & Immigration Appeal
As a judicial review and immigration appeals lawyer in BC, we know an IRCC refusal isn’t automatically the end of the road, but not every refusal is worth challenging either — the first step is an honest assessment of whether a judicial review or appeal actually has a real chance of succeeding on the facts. We also assess any alternative better serving your goal than the judicial review. Where it does, we represent you with a creative, progressive approach grounded firmly in the truth of your case, backed by 19 years of legal experience navigating exactly these kinds of immigration disputes. We build the argument around what the evidence actually supports, not what merely sounds persuasive on paper, so you’re never spending time and money pursuing a challenge that was never going to succeed.
How It Works
Katrina Berube Law walks with you every step of the way — whether you’re facing a family law matter, navigating an immigration application or judicial review, or putting a prenuptial agreement in place before you begin. Wherever you’re starting from, we walk it with you, in good faith.
Step 1
Assessment
We start by understanding where things truly stand. For family matters, we assess the level of transparency between both parties and the realistic probability of reaching an amicable resolution — through a separation agreement, uncontested divorce, or fair prenuptial agreement. Where transparency isn’t yet there, we tell you plainly, because an honest assessment now saves cost and conflict later. For immigration matters, we evaluate your full circumstances to map the optimal path to Canada, grounded in what actually qualifies you — not just what you hope will.
Step 2
Building a Strong Case
In family matters, once amicable resolution looks realistic, we build the case through transparent negotiation — a fair position on every term that matters: parenting arrangements, child support, spousal support, and property division. For prenuptial agreements, we build an airtight structure that protects what you brought into the relationship while respecting your partner’s entitlements. For immigration matters, we represent your case with a creative, progressive approach within the frame of truth. And where a notarized document is what the moment calls for, we handle that too, with the same care.
Step 3
Final Submission
Once terms are settled in family matters and your story is built with supporting documents in immigration matters, we translate them into binding documents. Family matters are formalized as a separation agreement or prenuptial agreement and, where appropriate, submitted alongside your divorce application. Immigration files are prepared for IRCC with complete supporting evidence, built to hold up under review. Where a document requires notarization or legalization for use here or abroad, we handle that directly. The result: your legal position is locked in, not left open to dispute later.
Ask Us
Most firms handle family law and immigration as separate practice areas, each with its own procedure and its own file. Katrina Berube Law treats both under one standard: full financial and factual disclosure before any position is negotiated or any application is filed. Nineteen years of practice in Vancouver and across BC back this approach — direct communication with clients and opposing counsel, and fees set upfront, before the work begins, not explained after the invoice lands.
It depends on your situation, but most cases start with a few basics.
For family law matters: your marriage certificate, and — if support or property division is involved — three years of Notices of Assessment (NOAs), proof of what you and your partner own (property title or appraisal, RRSP and investment statements, bank statements, records for stocks or cryptocurrency), and documentation of any significant gifts received during the relationship. Whatever you claim needs to be supported by documents.
For immigration matters: your passport, current visa, immigration history, birth certificate (in the form specified by IRCC for your country of birth), diplomas or transcripts, resume, employment or experience certificates, language test results, and a criminal record check, along with your marriage certificate if a spouse or family member is part of the application. Anything that supports your qualifications or eligibility is worth including — we’ll tell you if something isn’t needed.
Once we understand your situation, we’ll give you a clear, specific checklist so there’s no guesswork on your end.
We accept primarily e-transfer, and secondarily online bank transfer, debit or credit card, cheque, or money order. As a matter of firm policy, we keep cash payments to under $1,000 per matter — well below the Law Society’s $7,500 limit — to keep your file simple and fully traceable from day one.
